Terms and Conditions
1. THE OPERATOR AND GUEST
This agreement confirms the terms and conditions between the “OPERATOR” and the “GUEST.” The OPERATOR refers to Martin Adventours S.A. The GUEST refers to the customer using the OPERATORS services.
2. RESERVATIONS
The GUEST’S reservation must be made in advance through the OPERATOR's official websites, authorized agents, or customer service center. All reservations are subject to availability and only confirmed upon receipt of a confirmation email.
3. PAYMENTS
GUEST payments for all tours are due and payable at the time of reservation unless a special arrangement has been made with the OPERATOR. GUEST payments can be made online through our secure payment portal, and we accept major credit cards or other specified payment methods. Late payments may result in your reservation's cancellation, and the applicable cancellation fees will apply.
4. DEPOSITS
GUESTS who have secured a reservation with a 50% deposit must pay the remainder of their reservation in full 14 days prior to the tour date or the tour will be canceled and the deposit forfeited.
5. CONFIRMATIONS
Upon successful payment of the total amount, the GUEST will receive a confirmation email with essential details, including the itinerary, meeting points, and contact information. The GUEST must review the confirmation carefully and notify the OPERATOR immediately of any discrepancies.
6. INSURANCE
The OPERATOR advises all GUESTS to obtain insurance to protect themselves against unexpected incidents, such as cancellations due to illness, accidents, injuries, or personal liability. The OPERATOR cannot be held accountable if a GUEST has inadequate insurance. It is the responsibility of the GUEST to secure insurance as the OPERATOR does not offer travel insurance. All tours include liability insurance of $200.000.00 dollars.
7. CANCELLATION & REFUND POLICY
Cancellations made within 14 days of the tour departure date may be subject to a cancellation fee of up to 50% of the total tour price. No refunds will be provided for no-shows and cancellations made 48 hours or less before the scheduled departure date. No reimbursement will be made if participants do not arrive at the meeting point 30 minutes prior to the agreed time. The cancellation process and rules apply equally to in-person, by-phone, email, and online reservations. Refunds may take up to eight weeks or longer to process.
7.1 DEPARTURE TIMES
The GUEST agrees to arrive 30 minutes prior to the tour departure time at the designated location. The GUEST understands that activities are scheduled to depart at different times depending on the distance to the destination. If the GUEST arrives after their assigned departure time, they may not be allowed on the tour and will not be given a refund. Late arrivals are considered no-shows, and there may not be enough time to prepare them for the tour, and it would delay the tour for other paying GUESTS.
7.2 IF THE OPERATOR NEEDS TO CANCEL THE TOUR
If a tour must be canceled due to unforeseen circumstances, such as adverse weather conditions, natural disasters, demonstrations, road blockades, government orders (e.g., Ministry of Health, ICT), or other emergencies, the GUEST can reschedule for a later date or request a refund.
8. RIGHT OF ADMISSION
The OPERATOR reserves the right of admission.
9. SAFETY & RISK
If the safety of the OPERATOR or GUEST is at risk due to the weather or other factors, the OPERATOR reserves the right to stop operations. The GUEST understands that this is an outdoor activity and assumes the risks of weather or ocean conditions that may pose a risk to their safety and prevent access to the destinations included in the tour during its normal operation. The OPERATOR reserves the right to adjust the tour route for the safety of the OPERATOR and GUEST. Preparing for the unexpected is essential when engaging in outdoor activities. The GUEST should take the necessary precautions beforehand and obey the OPERATOR to ensure a safe and enjoyable experience.
9.1 SAFETY BRIEFINGS

10. CONFIDENTIALITY
The OPERATOR is committed to maintaining strict confidentiality of all personal information of its customers in compliance with applicable legal regulations. Visit www.martinadventours.com/privacy-policy for our full Privacy Policy.
11. PHOTOGRAPHY RELEASE CLAUSE
By participating in any activities or services provided by the OPERATOR, the GUEST hereby grants the OPERATOR the irrevocable and unrestricted right to use and publish photographs and/or videos taken during the course of the tour for promotional, advertising, and marketing purposes on OPERATORS's official website and social media platforms. Additionally, in the event that the GUEST independently publicly posts images or videos related to the OPERATOR on their personal or public social media accounts, the GUEST grants the OPERATOR the right to share, repost, or use these images for the same promotional, advertising, and marketing purposes. The GUEST acknowledges that these materials may be used without further approval, compensation, or notice. The GUEST also agrees that the OPERATOR retains the full copyright of any images or videos featuring the GUEST and releases the OPERATOR from any claims or demands in connection with the use of said materials. If the GUEST wishes to restrict the use of specific images or has any concerns regarding the use of their likeness, the GUEST must express these concerns in writing to the OPERATOR via email to support@martinadventours.com before the engagement or promptly after being made aware of the use, specifying the images or materials in question.
12. CHANGES IN TERMS AND CONDITIONS
The OPERATOR reserves the right to modify these Terms and Conditions without prior notice at any time. GUESTS can find the updated version of the OPERATOR’S Terms and Conditions at www.martinadventour.com/term-and-conditions.
13. PARTICIPANT AGREEMENT, RELEASE, AND ASSUMPTION OF RISK (WAIVER)
In consideration for being allowed to participate in the tour operated by the OPERATOR, the GUEST agrees to the following terms and conditions:
13.1 ASSUMPTION OF RISK
The GUEST is aware that participating in a tour involves inherent risks and dangers, including but not limited to the risk of personal injury, property damage, and death. The GUEST understands that these risks may result from the actions, negligence, or failure to act of the OPERATOR, its employees, agents, or other participants.
13.2 PHYSICAL CONDITION
The GUEST certifies that they are physically fit, do not have any medical conditions that would prevent them from participating in the tour, and have not been advised otherwise by a qualified medical professional.
13.3 COMPLIANCE WITH RULES
The GUEST agrees to comply with all rules and regulations established by the OPERATOR for the tour. I understand that failure to do so may result in the GUESTS immediate removal from the tour without any refund.
13. 4 PERSONAL PROPERTY
The GUEST acknowledges that the OPERATOR is not responsible for any loss or damage to the GUESTS personal property during the tour.
13.5 MEDICAL TREATMENT
In the event of injury or illness, the GUEST authorizes the OPERATOR to seek medical treatment on their behalf and agrees to be responsible for all associated costs.
13.6 RELEASE OF LIABILITY
The GUEST hereby releases and discharges the OPERATOR, its owners, employees, agents, and any third parties acting under its authority from any and all claims, liabilities, demands, actions, causes of action, costs, and expenses, whether at law or in equity, known or unknown, arising out of or in connection with the GUESTS participation in the tour.
13.7 MINORS
If the GUEST is a minor, this agreement must be signed by a parent or legal guardian, who assumes all responsibilities and obligations under this waiver on behalf of the minor.
By using any services, purchased or free, from the OPERATOR the GUEST agrees to all Terms and Conditions, the GUEST acknowledges that they have carefully read this agreement, understand its contents, and voluntarily agree to its terms. The GUEST further acknowledges that this agreement is binding upon them, their heirs, executors, administrators, and assigns. The OPERATOR looks forward to providing the GUEST with an unforgettable experience on their upcoming tour with Martin Adventours S.A.
